Terms of use

1. Purpose and acceptance

MyWorkers is a matching platform, operated by Green Acquisition Ltd (see the legal notice), between clients — individuals or businesses — and independent workers located in Madagascar. MyWorkers is neither the workers' employer nor a party to the service contract between a client and a worker: the platform provides the matching, the messaging, secure payment with escrow, daily mission follow-up and the dispute arbitration described below. Creating an account constitutes acceptance of these terms and of the privacy policy. The applicable version is the one published on the site on the date of your booking; we notify you by email of any substantial change, which applies to bookings made after its publication.

2. Accounts and email confirmation

Registration is free. Each person holds a single account, opened under their real identity, and keeps their password confidential: any action taken from an account is deemed to be taken by its holder. On registration, a confirmation link is sent to the email address provided; until it has been opened, the account can neither sign in nor act, and it is deleted automatically 48 hours after registration if it has not been confirmed — the address then becomes available again. Individual and business clients have the same services; a business client also provides its company name.

3. Worker profile approval and changes

A worker registers freely, but their profile is only published in the catalogue after manual review by our team: identity, declared experience, consistency of the profile and, where relevant, an interview, tests and references. A profile may be refused with reasons. A worker declares one or more professions. On a profile that is already published, any change to professions or skills is reviewed by our team before going live; the profile remains visible with its previous information during that review. Other information (headline, presentation, photo, city, languages, hours offered per day) is updated immediately. The public catalogue shows the worker's first name and the initial of their last name, their photo, city and skills.

4. What the client buys

The client buys neither a one-off task nor a deliverable, but a monthly volume of hours: 2, 4 or 8 hours per day, Monday to Friday, on an agreed time slot, expressed in Paris time and shown in Madagascar time to the worker. The price is the same whatever the profession: €250, €500 or €1,000 per month depending on the volume, exclusive of VAT (see the legal notice). These amounts are fixed at the time of booking and do not change during the month. Public holidays are not deducted: the mission calendar only knows weekdays.

5. Booking, acceptance and start

Booking is made from the worker's profile, by bank card through our payment provider Stripe. At the time of booking, the month's amount is only authorised on the card: it is held, not charged. The worker has 24 hours to accept or decline the request; we remind them after that. If they decline, or if the authorisation expires for lack of an answer (at the latest six days after the request), nothing is charged and the hold is released by the client's bank. Until the worker has accepted, the client may cancel freely and at no cost from the booking page. On acceptance, the amount is charged and the mission starts at 00:00, Paris time, on the first weekday following acceptance (an acceptance on Friday evening gives a Monday start). It ends at 23:59 on the last weekday before the same date the following month. The exact dates are shown in the mission thread and by email.

6. Payment, escrow and release of funds

The amount charged is held in escrow by the platform for the whole mission. It is released automatically to the worker at the end of the last day of the mission, without validation by the client: the absence of a dispute during the month constitutes acceptance of the service. A client with a platform balance (credit from an arbitration or a commission) sees it deducted automatically from their next booking; only the remainder is requested from the card. If the worker is suspended during a mission, the release is withheld until an agent decides, paying the worker for the weekdays actually worked and returning the rest to the client as balance. There is no subscription and no automatic charge: no payment is ever triggered without an action by the client.

7. Renewal

At the end of a mission, the client may request its renewal for one more month, at the same price and on the same slot. Renewal follows exactly the path of a first booking: new authorisation on the card, worker's agreement within 24 hours, charge on acceptance, start on the following weekday. The worker remains free to decline a renewal.

8. Pay, commission and tips

On each mission, the platform keeps 50% of the amount paid by the client; the remaining 50% goes to the worker. The client may at any time, during or after the mission, send a tip to the worker: between €5 and €1,000, charged immediately to their card, it goes entirely to the worker after deduction of the payment provider's fees only. A tip is non-refundable and is not part of the basis of an arbitration.

9. Referrals and business introducers

Each account has a referral code. A client may only refer clients: they receive 12.5% of the amount of each mission paid by their referrals, credited to their balance seven days after the end of the mission, in proportion to the sums actually kept by the worker after any arbitration. A worker may only refer workers: they receive, once, 10% of the margin kept by the platform on each referral's first mission, under the same conditions. Partner accounts, designated by the platform, may refer both types of account and have a dedicated dashboard. The referral is attached to the referred account at registration and cannot be added later; it only takes effect once the email address is confirmed. Self-referral — the same user, the same card or the same details on both sides, or a referrer booking their own referral — is prohibited: the corresponding commissions are suspended and reviewed by an agent, who may reinstate or cancel them. Commissions are paid out like earnings, under the conditions of section 18.

10. Daily reports

The client buys a volume of hours: they must see what those hours produce. For each weekday of the mission, the worker writes a report of what they did, on the same day or on the next weekday at the latest; after that, entry is closed. The worker is reminded by email as soon as a report is missing, and the mission is flagged to our team after three consecutive missing days. The client receives a weekly summary every Friday. These reports are evidence in the event of a dispute.

11. Worker availability

A worker may serve several clients on separate time slots, up to 8 hours per day; within that limit, they set the number of hours they offer. No exclusivity is granted. Two missions cannot overlap on the same time slot with the same worker; a pending authorisation request already reserves the slot.

12. Messaging and moderation

A client may write to a worker from the catalogue before any booking, without commitment or bank card, to describe their need; a mission thread then opens for each booking. Sharing personal contact details there (phone number, email address, social network or messaging handles, appointment links) is prohibited: it aims to bypass the platform and deprives the worker of the escrow protection. Messages containing such details are blocked automatically and are not delivered. Clear cases lead to a warning recorded on the account; repeated attempts may lead to suspension.

13. Review of exchanges by the platform

Conversations held on MyWorkers' messaging, as well as daily reports, may be reviewed by the platform's agents for moderation, prevention of bypassing and dispute arbitration. This access is permanent and is not limited to disputed files; messages blocked by the filter are kept and reviewable. Every intervention by an agent (decision, suspension, payout, reply) is recorded in an internal log. These exchanges are never disclosed to third parties except as required by law. For an exchange you do not wish to be reviewed, use another channel — bearing in mind that leaving the platform to organise the service is a breach of these terms.

14. Disputes

The client may open a dispute from the mission page for its whole duration, and up to 7 days after its end date; after that, no claim is admissible on the mission concerned. Opening a dispute suspends the automatic release of funds if it has not yet taken place, and both parties may continue to file reports, marked as such. A platform agent joins the conversation, each party provides its elements, and the agent decides within 48 working hours where possible, with one of three outcomes. Dismissal: the dispute is set aside, the mission resumes until its original end date and the funds stay in escrow. End by mutual agreement: the mission stops on the date agreed between the parties. Arbitration: the agent sets the number of weekdays actually worked; the worker is paid pro rata for those days, and the rest is returned to the client.

15. Refund to the client

The share returned to the client after an arbitration is credited to their platform balance, usable on any later booking and without expiry. The agent may decide to refund it to the card used for payment, up to the amount actually charged, in particular when the client does not intend to book again. The platform balance cannot be converted to cash on request.

16. Dispute opened after the end of a mission

When a dispute is opened after the funds have been released, the amount due to the client is first recovered from the worker's balance not yet paid out, up to the share they should not have received. A worker's balance can never become negative: if the sums have already been paid out, the platform bears the difference. No replacement is offered on a dispute after the mission; the client uses their balance to book another worker.

17. Worker replacement and guarantee

A client who is not satisfied with the worker may request their replacement during the mission, from the mission page, by opening a dispute with a replacement request. The request is reviewed by an agent within 48 working hours and follows the arbitration procedure of section 14: unused days are credited to the client's balance, and the replacement is granted or refused with reasons. If granted, the original brief is carried over automatically into the new booking and the balance is deducted from the replacement's payment. No paid day is lost because of a replacement: the guarantee covers the preservation of unused days as a balance usable on the platform.

18. Payouts to workers and introducers

A worker's earnings and an introducer's commissions accumulate on their account balance. To be paid, the holder enters their payout details in their settings: a Malagasy mobile money account (MVola, Orange Money or Airtel Money) or a Payoneer account, in the name of the MyWorkers account holder. Payouts are made by a platform agent once a month, in euros, with transfer fees borne by the platform. The part of a balance arising from a mission that ended less than 7 days ago may be deferred to the next payout, for the duration of the dispute window. For safety, a payout to details changed less than 72 hours ago, or on an account whose password has just been changed, undergoes an additional check. No payout is made to a suspended account without an express decision by an agent. Each payout is notified by email and visible in the beneficiary's account.

19. Reviews

At the end of a mission, the client and the worker may each leave a review of the other, within 14 days of the end of the mission: a rating and a comment of at most 500 characters, to which the person reviewed may reply. Only the parties to a mission that actually took place may review each other. An average is only shown on a profile from three reviews. The platform removes any review that is abusive, defamatory, off-topic or aimed at bypassing these terms.

20. Status of workers

Workers are independent contractors established in Madagascar. They organise their activity freely, may serve several clients and may decline any request. They are solely responsible for their tax and social obligations in their country. MyWorkers has no power of direction over them; the client defines the need and the content of the tasks within the volume of hours purchased.

21. Right of withdrawal of individual clients

An individual client has 14 days from their booking to withdraw. As the mission starts as soon as the worker accepts, i.e. before the end of that period, the client expressly requests, when booking, the immediate performance of the service: they keep their right to withdraw as long as the worker has not accepted (free cancellation from the booking page) and, after acceptance, may only do so for the part not yet performed, by opening a dispute; the part performed remains due pro rata to the weekdays worked. Business clients do not have this right.

22. Suspension and account closure

The platform may suspend an account in the event of a breach of these terms, in particular repeated attempts at bypassing, abusive behaviour, self-referral or false statements. A suspension is reasoned; a suspended account loses access to its space, bookings, messaging and catalogue, but keeps access to the Support section to appeal. A worker suspended during a mission is paid pro rata for the days worked, on an agent's decision. Any user may ask for their account to be closed at contact@my-workers.fr; sums due remain paid under the rules above, and data is kept under the conditions of the privacy policy.

23. Liability

MyWorkers undertakes to review profiles before publication, to secure payments and to arbitrate disputes in good faith, but does not guarantee any particular professional outcome: the worker remains solely responsible for performing the service. The platform cannot be held liable for indirect damage related to the service, nor for a temporary unavailability of the service. Its liability, if engaged, would remain limited to the amount of the mission concerned, without prejudice to the rights granted to consumers by law.

24. Complaints and mediation

Any complaint is first addressed to the platform, from the Support section of your account or at contact@my-workers.fr; we reply within two working days. In accordance with the French Consumer Code, an individual client who has not obtained satisfaction may use a consumer mediator free of charge. [Mediator to be appointed: name and website of the mediator the platform subscribes to.]

25. Governing law and jurisdiction

These terms are governed by French law, subject to the mandatory provisions of English law applicable to the publishing company. In the event of a dispute, the parties will seek an amicable solution before any action. Failing agreement, and for business clients, the dispute will be brought before the competent courts of Paris; an individual client keeps the right to bring the matter before the court designated by law.
